These Terms

These Terms of Sale together with all information and documents referred to in them, govern your purchase of products, including prescription-only products, from the Juniper website.

Please make sure you read these Terms of Sale carefully before. If you do not agree to these Terms of Sale, you should not purchase any products on the Juniper website. By ordering the products you confirm that you agree to these Terms.

We reserve the right to amend these Terms of Sale from time to time. We recommend that you print a copy of these Terms of Sale for future reference.

Information about us

These Terms of Sale are provided to you by Juniper Technologies UK Ltd ("Juniper") a company that is  incorporated in England and Wales with company number 13901454 and whose registered office is at 12 New Fetter Lane, London, United Kingdom, EC4A 1JP and Fill Function UK Limited (the "Pharmacy"), an affiliate company of Juniper, that is incorporated in England and Wales with company number 13739688 and whose registered office is at 12 New Fetter Lane, London, United Kingdom, EC4A 1JP. The Pharmacy is a registered pharmacy, registered with the General Pharmaceutical Council with registration number 9011842. Our pharmacy address is Units 17 & 18, Union Way, Aston, Birmingham, B6 7FH.

We sell prescription-only products (medicines) and over-the-counter products (together in these Terms of Sale known as products) to help customers on their weight loss journeys.

If you are purchasing prescription-only products (medicines) from us then you enter into these Terms of Sale with the Pharmacy. If you are purchasing any over-the-counter products then you enter into these Terms of Sale with Juniper.

Orders

You must be 18 or over. To place an order for a product you must be 18 years of age or over. By placing an order, you confirm that you are in this age range and are legally capable of entering into a binding contract.

You must be in the United Kingdom. We only ship and sell products to individuals in the United Kingdom.

We will tell you when we have accepted an order. When we receive an order from you to purchase products from us, we will confirm that we have received the order by email to the address provided by you in your order. Your order is an offer to us to purchase a product and will not be binding on us until we have accepted it. Our acceptance of your order will take place when we notify you we have accepted it.

We (or an affiliate on our behalf) will charge you when we accept your order. However, this depends upon whether the product is a one-off purchase or as a subscription. All prescription-only products are sold on a subscription basis. For prescription-only products we take payment at regular intervals, as explained to you during the order process.

Sometimes we reject orders or cancel orders. This might be because the product is out of stock, there is a problem with authorisation of your method of payment, because you are outside of our stated delivery areas (i.e. outside the UK) or because we have identified an error in the price or description of the product. For prescription-only products, this might also be because your prescriber has confirmed that you are not suitable for the prescription-only product. We will always try to pick up any of these prior to us accepting your order but this is not always possible and so sometimes we may have to cancel your order. When any of this happens, we let you know as soon as possible and refund in full any sums you have paid to the payment card that you used to place the order.

Prices and Payments

Prices are shown on the website. Prices of products shall be those prices published on the Juniper website at the time you submit your order.

Subscription payments will be taken monthly. Prescription-only products are sold to you on a monthly subscription basis. The subscription plan consists of an initial payment followed by recurring period charges, on or around the same time as your initial payment. By agreeing to these Terms of Sale, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.

Delivery costs are included in the cost of your order. The total price stated on the order form you submit shall be the total amount payable by you for the product(s) including shipping.

All products

Products may vary. Product packaging may vary from that shown in images on our website.

We may withdraw products at any time. We can stop providing a product. We let you know in advance if this will affect you and we refund any sums you've paid in advance for products which won't be provided.

Prescription-only products

Prescription-only products are for you only: We will issue the prescription, to you only, if a valid prescription has been issued by a prescriber based upon a personal consultation on the Juniper platform. All the prescribers on the Juniper platform are registered in the United Kingdom with the General Pharmaceutical Council and hold accredited pharmacist independent prescriber qualifications. We do not dispense any prescription-only product to anyone on your behalf. The prescription-only products are dispensed to you solely for your own personal use, to treat a specific condition that has been identified as applicable to you, and must not be shared with or used by any other person.

Prescription-only products are sold to you as a subscription. Unless otherwise cancelled or amended in accordance with these Terms of Sale, your subscription is valid for the period for which your prescription covers. 

You can take a break from, suspend or cancel your subscription. If you wish to take a break from your medication or change your shipment dates you can do so through your Juniper profile. If you want to cancel your subscription please contact us at: hello@myjuniper.co.uk

Tell us if you think your delivery is very cold or very hot. We use packaging to keep your prescription-only product at the correct temperature in transit to you. If for any reason you believe your prescription-only product has arrived under 0 degrees celsius or above 30 degrees celsius, please contact us.

Prescription-only products must be placed in the fridge immediately upon delivery. This is your responsibility. We accept no liability for any loss, damage or injury arising as a result of your incorrect storage of the products. 

You should read all the information provided. You are responsible for taking any prescription-only product correctly. You should carefully read any information provided with your prescription-only product (including, but not limited to, the dispensing label and the patient information leaflet). 

Our responsibilities to you where you are purchasing prescription-only products. We are responsible for dispensing your prescription correctly and complying with the legal requirements placed upon pharmacies.

We are not responsible for your prescriber. Your prescriber is responsible for issuing your prescription. We are not responsible for the accuracy of the prescription-only product prescribed by your prescriber.

Changes to your order

If you want to make a change. If you wish to make a change to your order, please contact us to see if this is possible. 

Changes we can always make. We can always change a product to reflect changes in relevant laws and regulatory requirements.

Cancellations, returns and refunds

Prescription-only products:

No refunds. Please tell us as soon as possible after you place your order if you want to cancel. Provided the products have not been dispensed, we may be able to offer you a refund. Once dispensed we are unable to re-use the product and offer you any refund. However, we cannot offer any refunds for any repeat orders after the initial order if you have already been charged. This is in line with UK consumer law, which provides that prescription-only medicines cannot be cancelled or refunded due to a change of mind.

We can only provide replacements or, in certain circumstances, refunds on prescription-only products in cases of faulty, damaged or wrong product. Please contact us if you believe your prescription-only product is faulty, damaged or wrong. 

All other products:

You can change your mind but there is a deadline. You are eligible for a refund on any other products shipped to you provided that you contact us within 14 calendar days from the day after the products are delivered. You then have another 14 days from that date in which to return the product to us.

When you cannot change your mind. You are only eligible for a refund if the product is unused and in the same condition as which you received it. Otherwise, you will lose your right to a refund.

You have to return the product at your own cost. You will be responsible for the delivery costs when sending any products back to us.

You also have rights if there is something wrong with your product and you tell us within 30 days. You may be eligible for a replacement or, in certain circumstances, a refund. Please contact us if you believe your product is faulty, damaged or wrong.

Delivery

Delivery address. We will deliver the products to the delivery address you have specified when you ordered the product. It is your responsibility to ensure that you have given us the correct delivery address.

Delivery times. All our products will usually be delivered with a courier using the next day delivery (except for remote locations), subject to the time of day you place the order and any events outside of our control. For example, orders placed over the weekend or later on a Friday will be treated as being placed on a Monday. Delivery times for remote locations are different, as described below.

Remote Locations. We aim to deliver within two days to remote locations, but are not always able to do so depending upon your particular delivery address, the time of day you placed the order and events outside of our control. The following delivery locations are considered remote locations: Northern Ireland, Scottish Islands, Scottish Highlands, Isle of Wight and the Scilly Isles. 

Bank holidays. Orders will not be posted or delivered on bank/ public holidays. 

Delivery slots. We cannot guarantee the exact time of delivery. A one-hour delivery slot will be provided by our delivery partner, DPD. We strongly suggest you download DPD’s mobile application to have full visibility on deliveries. Look out for details in your confirmation of dispatch email.

Delivery options. If we are not able to deliver the product to your address, it may be left with a neighbour or any safe place you have specified. If delivery is still unsuccessful, you will be sent both an email and an SMS asking for you to rearrange delivery according to your chosen delivery method (e.g. re-delivery, drop-off/ pick-up).

Proof of delivery. Products may need to be signed for or a photo taken at the point of delivery as a proof of delivery. Please follow any instructions provided by our delivery partner, DPD.

WE ARE NOT RESPONSIBLE FOR EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to request a refund for any products you have paid for but not received.

Our liability to you

We are not liable for all losses. If we fail to comply with these Terms of Sale, we shall only be liable to you for the purchase price of the products and any losses that you suffer as a result of our failure to comply (whether arising in contract, tort (including negligence), breach of statutory duty or otherwise) which are a foreseeable consequence of such failure. This means we are not responsible for (i) any loss or damage that is not foreseeable at the time we enter into a contract with you; or (ii) any business losses. We are also not responsible for events outside our control per above.

However, we cannot exclude our liability for these losses. Nothing in these Terms of Sale limits or excludes our liability for fraudulent misrepresentation, death or personal injury resulting from our negligence or the negligence of our agents or employees, or any other liability that cannot be limited or excluded by law. Nothing in these Terms of Sale shall restrict your statutory rights.

Ending the contract

We can end our contract with you. We may also end the contract at any time by writing to you if (i) you do not within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products; (ii) you do not, within a reasonable time, allow us to deliver the products to you; or (iii) you do not make any payment when it is due, and still don't make payment within a reasonable time of us reminding you that it is due. We may also cancel the order for any of the reasons described under the section headed ‘Orders’.

You may end the contract in certain circumstances. Where you decide to end the contract, the contract will end immediately and we will refund you for any products that you have not been provided. The reasons you may end the contract are: (i) we have told you about any upcoming change to the products you have ordered and you do not wish to proceed; (ii) we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed; or (iii) there is a risk that supply of the products may be significantly delayed because of events outside of our control.

If you have any problems

Our complaints policy. Please contact us on the details set out on the Complaints page. We will do our best to resolve any problems you have with us or the products.

You can go to court. These Terms of Sale are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

Other important terms that apply

If a court invalidates these Terms of Sale, the rest of it will still apply. Each of the clauses of these Terms of Sale operates separately.  If a court or relevant authority decides that any of these Terms of Sale are unlawful, invalid or unenforceable, this will not affect the validity of the remaining Terms of Sale which will remain in full force and effect.

Even if we delay in enforcing these Terms of Sale, we can still enforce it later. If we fail to insist that you perform any of your obligations under these Terms of Sale, or if we delay or do not enforce our rights against you, this does not mean that we have waived our rights against you and does not mean that you do not have to perform your obligations.

Nobody else has any rights under these Terms of Sale. Nothing in these Terms of Sale is intended to nor shall it confer a benefit on any third party under the Contracts (Rights of Third Parties) Act 1999 and a person who is not a party to these Terms of Sale and Conditions has no rights to enforce them.

We can transfer our contract with you, so that a different organisation is responsible for supplying the product. We may transfer our rights and obligations under these Terms of Sale to any other organisation, including any of our group companies. If this happens, we will ensure that the transfer will not affect your rights under the contract. You cannot transfer these Terms of Sale to anybody else.
